Section 1. Right to Participation
Every person has the right to meaningful participation in the civic, political, and administrative decisions that affect their life, body, livelihood, and community. Participation shall be real, accessible, and capable of influencing outcomes, not merely symbolic or procedural.
Section 2. Access to Governance
Public institutions and decision-making processes shall be transparent, accessible, and intelligible. No person shall be excluded from participation through complexity, opacity, cost, or technological barrier.
Section 3. Due Process
No person shall be deprived of liberty, property, rights, or access to essential services without due process of law. Due process shall include timely notice, clear explanation, the right to be heard, and impartial adjudication.
Section 4. Procedural Fairness
Procedures governing benefits, obligations, penalties, or enforcement shall be fair, timely, and proportional. Delay, administrative burden, or procedural complexity shall not be used to deny or deter access to rights.
Section 5. Protection Against Arbitrary Action
No authority shall act arbitrarily, capriciously, or without stated justification grounded in law. Decisions affecting persons shall be reasoned, documented, and subject to review.
Section 6. Accountability and Remedy
Every person has the right to seek redress for governmental or delegated action that violates this Constitution. Remedies shall be effective, timely, and not contingent upon excessive cost, exhaustion, or deference.
Section 7. Equal Application
The rights secured by this Article apply equally to all persons and shall not be diminished by status, citizenship, wealth, or access to representation.
Section 8. Interpretation
This Article shall be interpreted to expand participation, transparency, and procedural fairness. Ambiguity shall be resolved in favor of access, accountability, and human agency.
Section 9. Enforcement
Violations of this Article shall be recognized as violations of fundamental rights and shall be subject to immediate judicial remedy, without requirement of exhaustion, delay, or deference.
Section 10. Non-Derogation
The rights secured by this Article shall not be suspended, limited, or reinterpreted under any circumstance except through amendment by the people.
Due process under this Article shall be substantive and meaningful, not merely procedural, and shall include timely notice, clear explanation, and an accessible opportunity to challenge decisions.
